Oxenhandler acknowledged in his ruling the deposition probably "will be a fruitless endeavor" and added that he would reconsider the motion if Isaacson does not produce the photos on Monday.
While Maneke declined to speculate on what could happen Monday, Tribune Managing Editor Jim Robertson said it’s unlikely Isaacson will turn over the photos.
The paper has resisted releasing the photos, arguing that state case law and federal precedent gives it a First Amendment right to disseminate information as it chooses.
"We still don’t plan to hand over the photos," Robertson said, "at least until a judge tells us to."
Isaacson vowed today not to turn over any of the additional photos next week.
"I’m not giving them the photos because my job is to be a photographer for the Tribune, not a photographer for the court system," she said.
